Welcome to primofish.org. By accessing or using this website, purchasing products, or booking charter services, you agree to these Terms and Conditions.
1. General
These Terms govern your use of the site and all purchases and bookings made through it. We reserve the right to update these Terms at any time. Continued use constitutes acceptance of the updated Terms.
2. Products
We sell fishing tools (including our patented pliers with built-in de-hooker) and apparel. Product descriptions, images, and pricing are believed accurate but may contain errors. We reserve the right to correct errors and cancel orders if necessary.
3. Charter Services
Charter bookings are subject to availability, weather, and vessel conditions.
• All participants must follow the captain’s instructions at all times.
• Assumption of Risk: Fishing and especially spearfishing involve inherent risks including but not limited to drowning, injury from marine life, equipment failure, weather, and vessel motion. By booking, you acknowledge and voluntarily assume these risks.
• You agree to sign any liability waiver/indemnity agreement we require before boarding.
• Minors must be accompanied by a parent or legal guardian who accepts responsibility.
• We reserve the right to refuse service or cancel a trip for safety, weather, or behavioral reasons.
4. Orders and Payment
All prices are in U.S. dollars. Payment is due at the time of order or booking unless otherwise agreed. We use secure third-party payment processors.
5. Intellectual Property
All content on this site (text, images, logos, product designs, including the patented pliers design) is owned by Primofish or its licensors and is protected by copyright, trademark, and patent laws. You may not copy, reproduce, or use our content or product designs without written permission.
6. Limitation of Liability
To the fullest extent permitted by Florida law, Primofish and its owners, captains, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the site, products, or charter services. Our total liability for any claim related to products shall not exceed the amount you paid for the product. For charter services, liability is further limited by the signed waiver and applicable maritime/Florida law.
7. Indemnification
You agree to indemnify and hold Primofish harmless from any claims arising from your use of the products, your participation in charters, or your violation of these Terms.
8. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the state or federal courts located in Florida.
